Wayleave Payments

New wayleave compensation scales have been recommended to compensate landowners and farmers for the presence of electricity companies’ apparatus on their land. Energy Networks Association’s Estates & Wayleaves Forum representing the electricity companies has concluded discussions with the Country Land & Business Association, the National Farmers’ Union and the Farmers Union of Wales, the schedule of new rates is attached. These rates are paid to reflect the inconvenience and interference to farming caused by the presence of the electrical apparatus on farmland.

Wayleave compensation comprises two elements divided between owners and occupiers – owner/occupiers receive both payments. The recommendation as to the revised scale payable to owners takes effect from 1 April 2011 having been settled for a four year period to 31 March 2013 and rates will increase in line with the terms of that agreement. The recommendation with regard to the rates applicable to occupiers also takes effect from 1 April 2011 and will continue to be reviewed annually in accordance with the detailed studies undertaken by ADAS. Farmers do not need to apply to their electricity company for the increases.
